<TD class=pageHeading width=325 height=20>“不准改签、不准更改、不准退票”乘客在购买特价机票时往往也习惯了航空公司的这“三不准”原则，但直至近日甘肃省消费者协会公开致函民航总局要求改变这种不合理的退票办法时，人们才发现，这种不准退票或收取高额退票费的行为原来是“霸王条款”！
<P> <STRONG> 乘客：“三不”令机票成“废纸”</STRONG></P>
<P> 吴先生通过某票务公司以4折的价格购买了一张由广州飞往成都的机票，并支付了票款520元。由于一些急事耽误了行程，吴先生赶到机场时距离飞机起飞时间还剩下35分钟，航空公司工作人员拒绝为他办理登机手续。但拿着机票去退票时，工作人员让其到购票地退款，赶到出票的这家票务公司，却被告知这是一张“不准改签、不准更改、不准退票”的机票。</P>
<P> 像吴先生这种遭遇的乘客还有很多，这一切都起始于各大航空公司关于“退票费”的一些硬性规定，比如对于全价机票，乘客可以任意更改和签转；对于折扣机票，机票上一般都会注明不得签转、不得更改的字样，这些折扣机票是不允许乘客签转或者更改的。</P>
<P> <STRONG> 消费者协会：民航总局应改不合理规定</STRONG></P>
<P> 对此，甘肃省消协率先开口，公开致函民航总局等三大运输主管部门，向退票费开炮，要求改变有关不合理的退票费收取办法，并要求民航总局等部门在10日内作出书面答复。</P>
<P> 甘肃省消协秘书长刘兴斌表示，目前退票存在的问题：一是强制收取，违背了平等协商的原则。客运部门制定收取退票费，不举行听证会，不听取合同对方即消费者的意见，剥夺了消费者的知情权和平等协商权；二是退票费太高，违背了公平交易的原则，剥夺了消费者的公平交易权；作为客运部门，往往在延误或取消航班、车次后，均没有给消费者支付违约金，但是却强行收取高额退票费，这种做法显失公正、公平。</P>
<P> 为此，甘肃消协向民航总局建议：“对于能够再次发售的机票，航运部门并没有受到损失，不应当收取手续费；在航班规定离港24小时以内，2小时以前乘客要求退票的，民航部门应在扣除相应的成本之后，按不同时间段合理收取退票费；旅客在航班的经停地自动中止旅行，该航班未使用的航段票款应予以退还；持不定期客票的旅客要求退票，在客票的有效期内到原购票地点办理退票手续，民航部门应在收取适当成本费后予以退还其余票款。”</P>
<P> <STRONG> 民航总局：暂时不作任何回应</STRONG></P>
<P> 对此问题，记者昨天联系上了民航总局宣传部钟宁处长，她表示已经听说此事，目前正在询问相关职能部门，暂时还没有消息可对外发布。</P>
<P> 记者发现，民航总局并没有专门的相关文件对“退票费”加以规定，比如《中国民用航空旅客、行李运输规则》规定，机票可以签转、更改和退票，但是这一规定相对于全价票而言。而按照《民航国内航空运输价格改革方案》的规定，航空公司可以自行制定票价种类、水平、适用条件。</P>
<P> 业内人士告诉记者，所以对于特价机票，航空公司一般都是根据自己的实际情况来制定有关打折机票的相关规定，这在法律上还存在一定的空白。</P>
<P> <STRONG> 航空公司：购折价票时已说明</STRONG></P>
<P> 对于特价机票不准退票的相关规定，航空公司表示，“这在乘客购票前都已经说明的了，特价机票服务当然也特价，如果乘客不愿意购买这种特价机票，可以选择折扣更高的、可以退票的机票。这不是霸王条款或欺骗行为。”</P>
<P> <STRONG> 记者观察:“退票费”缺标准成监管空白</STRONG></P>
<P> 记者采访中发现，其实国家计委在2003年年初的时候曾出台了《规范旅客运输退票费意见》。《意见》除了要求各运输企业退票费最高不超过20%外，还要求“退票费的收取条件和收费标准，应由国务院各运输主管部门制定，不应由运输企业自行制定。”</P>
<P> 但目前作为主管部门的民航总局并没有出台相应的标准，导致“退票费”的规定由各个航空公司自己来制定，在这种情况下，本着“自身利益”最大化的原则来制定“退票费”的有关规定，这是招致乘客投诉的主要原因。（记者 王飞）</P><A name=#d></A></TD>
