<P> 霍寿金诉称，首先，《霍元甲》把民族英雄、爱国武术家霍元甲塑造成一个为争第一好勇斗狠，滥杀无辜，乱收酒肉徒弟的江湖武夫，并由此导致家破人亡，扭曲了霍元甲的形象。其次，该片表现霍元甲人生观的转变，包括他对武学精神的彻悟竟然是出于一个盲女的帮助，非常牵强，一代武学宗师寄人篱下七年之久并令人惊讶地被称作“阿牛”。再次，更为重要的是，该片出现了霍元甲的母亲与女儿被杀的血腥场面，极易使观看此片的观众误认为霍元甲已遭灭门之灾，这不仅是对霍元甲生前名誉的侵害，而且是对霍家后人名誉权的侵害，使他们的身份遭到怀疑，精神上受到严重伤害。
<P> 霍寿金认为，对于特定的真人真事如何进行文学虚构，法律有明确规定。然而，电影《霍元甲》已经超出了限度。虽然该片片尾已注明“纯属虚构”字样，但是该片片名《霍元甲》很容易让人认为是传记片。霍元甲是真实存在的历史人物，被告试图以“纯属虚构”免责，没有法律依据。故将两家电影制作发行单位诉至法院，要求停止发行《霍元甲》，公开赔礼道歉。
<P> 昨天下午，中国电影集团法务部工作人员表示，他们尚未接到法院传票，不便发表意见。此前，电影《霍元甲》编剧王斌曾表示，《霍元甲》的剧本创作并非完全根据史实，而是加入了一些虚构情节，是为表现影片主题作铺垫，并无不妥。（记者傅沙沙 通讯员韩玲）
<P> <STRONG>李连杰可能成被告</STRONG>
<P> 据新华社天津3月8日专电 霍家后人的委托律师、天津市明扬长缨律师事务所的杨仲凯称，本次诉讼的被告初步定为影片的出品方中国电影集团北京制片厂及发行方安乐电影有限公司，但是影片的其他编创人员如编剧王斌和拥有影片主演及出品人、投资人多重身份的李连杰，在举证期间有可能被追加为被告。
<P> <STRONG>被告强调并无恶意</STRONG>
<P> 昨天，中国电影集团、安乐电影有限公司的有关负责人，对霍寿金的诉讼表示不屑和无所谓。他们认为，《霍元甲》是故事片而非传记片，是歌颂、赞美霍元甲的，并无恶意。
<P> 中影集团有关负责人强调，《霍元甲》是故事片而非传记片，另外，影片褒扬了霍元甲这位民族英雄，从主观上并没有任何诋毁的意思，相信原告如果不提出其中的“灭门”细节，那么不会有什么人往那方面想。“如果这也算侵权，那么艺术创作太没有自由了。既然我们已经被告上法院，那么就得按照法律办事，在律师不在的情况下，不会讲更多。”
