<!DOCTYPE HTML PUBLIC "-//W3C//DTD HTML 3.2 Final//EN"><HTML><HEAD><TITLE> Royal Holloway Department of Computer Science </TITLE></HEAD><BODY BGCOLOR=white TEXT="#000000" LINK="#0000ff" VLINK="#ff0000" ALINK="#ffffff"><p><strong>IMPORTANT - READ CAREFULLY AND COMPLETE REGISTRATION FORM TOSHOW ACCEPTANCE OF THE TERMS OF THIS</strong> <strong>SOFTWARE LICENCEAGREEMENT</strong><br wp="br1"><br wp="br2"><p><strong>THIS LEGAL DOCUMENT IS AN AGREEMENT BETWEEN YOU ("THE LICENSEE") AND ROYAL HOLLOWAY AND BEDFORD NEW COLLEGE ("ROYALHOLLOWAY") OF EGHAM, SURREY TW20 0EX, UNITED KINGDOM AND AT&TLABORATORIES - RESEARCH ("AT&T") OF</strong> <strong>100 SCHULZ DRIVE, RED BANK, NJ 07701-7033, UNITED STATES OF AMERICA. BY COMPLETING THEREGISTRATION FORM AND CLICKING THE 'ACCEPT' ICON, YOU AREAGREEING TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT. ACCESS TO THE SOFTWARE IS ONLY ACTIVATED BY SUCH ACCEPTANCE.</strong><br wp="br1"><br wp="br2"><p>Royal Holloway and AT&T own the copyright in the computer program(s) "SVM" andassociated source code and user documentation contained<em> </em>on the Royal Holloway website"http:\\svm.dcs.rhbnc.ac.uk", which program(s) and documentation are hereinafter called "theSVM Software". In order to preserve and protect their rights under applicable laws, RoyalHolloway and AT&T do not sell any rights in the SVM Software but grant licences for the use ofthe SVM Software in accordance with the terms and conditions of this Agreement.<br wp="br1"><br wp="br2"><p>The Licensee wishes to be granted a licence by Royal Holloway and AT&T to use the SVMSoftware.<br wp="br1"><br wp="br2"><p>1 GRANT OF LICENCE<br wp="br1"><br wp="br2"><p>Subject to the terms of this Agreement, Royal Holloway and AT&T hereby grant to the Licenseea royalty-free, non-exclusive, perpetual licence to use the SVM Software. The Licensee shall beresponsible for installing the SVM Software. In consideration of the rights granted hereunder byRoyal Holloway and AT&T to the Licensee in respect of the SVM Software, the Licensee shall:<br wp="br1"><br wp="br2"><p>1.1 make reference to Royal Holloway and AT&T in any work published using results producedusing the SVM Software and include reference to the Royal Holloway Technical Report "SupportVector Machine - Reference Manual" CSD-TR-98-03 by C Saunders, M O Stitson, J Weston,L.Bottou, B.Schölkopf and A.Smola, published by Royal Holloway 1998 in the bibliography ofsuch publications;<br wp="br1"><br wp="br2"><p>1.2 provide Royal Holloway and AT&T with a copy of any work published using resultsproduced using the SVM Software;<br wp="br1"><br wp="br2"><p>1.3 provide to Royal Holloway and AT&T comments on the accuracy, performance and fitnessfor use of the SVM Software.<br wp="br1"><br wp="br2"><p>2 PERMITTED USE OF THE SVM SOFTWARE<br wp="br1"><br wp="br2"><p>2.1 The SVM Software is strictly for NON-COMMERCIAL USE ONLY and may only be usedfor research, evaluation or teaching purposes.<br wp="br1"><br wp="br2"><p>2.2 The licence permits employees of the Licensee to use the SVM Software only on one (1)computer. If such computer is part of a network of computers, then while the SVM Software isbeing accessed on such computer, the SVM Software shall not be copied to, or used on, any othercomputer on such network, nor shall the SVM Software be accessed for use through any othercomputer on such network.<br wp="br1"><br wp="br2"><p>3 OBLIGATIONS OF THE LICENSEE<br wp="br1"><br wp="br2"><p>The Licensee hereby undertakes that it will not:<br wp="br1"><br wp="br2"><p>3.1 make any use of the SVM Software other than as permitted under Clause 2 of thisAgreement; or<br wp="br1"><br wp="br2"><p>3.2 make any copies of the SVM Software other than as required for the purposes of thepermitted use under Clause 2 of this Agreement; or<br wp="br1"><br wp="br2"><p>3.3 cause, directly or indirectly, the transfer of the SVM Software to any third party, or theacquisition of the SVM Software by any third party; or<br wp="br1"><br wp="br2"><p>3.4 modify the SVM Software without the prior written consent of both Royal Holloway andAT&T.<br wp="br1"><br wp="br2"><p>4 WARRANTY<br wp="br1"><br wp="br2"><p>Neither Royal Holloway nor AT&T give any warranty and make no representation about theperformance or characteristics of the SVM Software.<br wp="br1"><br wp="br2"><p>5 LIMITATION OF LIABILITY<br wp="br1"><br wp="br2"><p>The Licensee shall assume full responsibility for any use by the Licensee or by any third party(including any employee of the Licensee) of the SVM Software and/or any other informationprovided under this Agreement and shall indemnify and hold harmless Royal Holloway andAT&T against any claims which may be brought against either Royal Holloway or AT&T arisingout of the said use of the SVM Software and/or such other information.<br wp="br1"><br wp="br2"><p>6 INTELLECTUAL PROPERTY RIGHTS<br wp="br1"><br wp="br2"><p>All intellectual property rights in the SVM Software remain the property of Royal Holloway andAT&T. At no time shall any property rights in the SVM Software or any part thereof be vestedin the Licensee. Royal Holloway and AT&T make no warranty or representation that the use ofthe SVM Software and/or any information provided by Royal Holloway or AT&T to theLicensee under the terms of this Agreement does not infringe the rights of any third party.<br wp="br1"><br wp="br2"><p>7 CONFIDENTIALITY<br wp="br1"><br wp="br2"><p>The Licensee shall take all reasonable precautions to ensure that the SVM Software is treated asconfidential.<br wp="br1"><br wp="br2"><p>8 TERMINATION<br wp="br1"><br wp="br2"><p>Royal Holloway and AT&T may terminate this Agreement at any time if the Licensee fails tocomply with any of the terms and conditions of this Agreement.<br wp="br1"><br wp="br2"><p>9 ASSIGNMENT<br wp="br1"><br wp="br2"><p>The Licensee shall not assign or transfer any rights, duties or obligations under this Agreement.<br wp="br1"><br wp="br2"><p>10 APPLICABLE LAW<br wp="br1"><br wp="br2"><p>This Agreement shall be construed in accordance with the laws of England and subject to thesole jurisdiction of the Courts of England.</P></BODY></HTML>⌨️ 快捷键说明
