<td><font class="f14">随着我们国家经济发展水平的提高和老百姓消费需求的不断升级，旅游消费已经逐渐成为公民当中日常消费的重要组成部分。如果准备出行，你应该做那些准备呢？<br><br>记者昨日采访了一些业内人士，从怎样选择旅行社说起，到如何解决旅途中遇到的一些法律问题，通过他们的提示，使游客有备无患，让自己的旅程更加美好。<br><br> <br><br>首先选好旅行社<br><br>省城某旅行社总经理韩先生告诉记者，由于青海省的旅游业刚刚起步，老百姓选择旅行社，一定要选择正规的，具有合法经营资质的旅行社。<br><br>价格因素很重要  决定游客选择的最重要的因素就是价格。老百姓往往通过广告来对比各个旅行社的价格，当然分了，也不能仅以“价格论英雄”，因为有的旅行社报价较低，有可能是把许多景点的门票、缆车等没有计算在内，一些价格特别低的旅行社，往往在背后隐藏着消费陷阱。<br><br>实力要考证  老百姓在准备出游的时候，在比较价格的同时，还应该了解一下旅行社的信誉度。现在旅行社很多，有个别的旅行社出现了甩团、服务质量差等现象，所以建议在选择旅行社的时候，应该到旅行社去看看，了解它们的规模和专业程度。从实力上考证。<br><br>线路设计考察好  每条旅游线路可以有不同的设计，不同的设计就有不同的成本。一般来说，好的线路的价格肯定要比其他线路的价格要高一些。作为游客，要看自己对哪条线路感兴趣，自己喜欢哪条线路。最重要的就是游客应该对出行的线路有详细的了解，比如是乘火车还是飞机，是早上走还是晚上走。对乘飞机的游客而言，飞机票价在晚上的折扣较大。<br><br>韩总经理说，游客一定要和旅行社签合同，如果不签订合同的话，一旦发生纠纷，则没有法律方面的保证。<br><br>的确，作为消费者，在外出旅游时将和旅行社，酒店，运输公司、景点之间发生一系列的法律关系。法律关系当然是为了调节利益关系而设计的一种法律制度，但是，在旅游领域当中，究竟应当注意什么问题呢，记者走访了海博律师事务所李强律师。<br><br> <br><br>依靠法律维权<br><br>一定要签订书面的合同，不能因为旅行社有一纸传真，或者有一个旅行日程的备忘录，就可以忽略合同的重要性。但是，怎么签好合同呢?建议在签订合同之前，一定要对那些旅行社提交的格式合同多研究，发现其中是否有合同陷阱。<br><br>李强律师从游客与旅行社所发生的合同纠纷当中，从比较普遍的、比较主要的几个问题出发，从合同法的角度分析如下：<br><br>第一，在旅游当中，如果旅行社增加了服务项目，或者增加了景点之类的，那么向游客加收费用因此引发的纠纷，应当怎么处理，这种案例是非常多的。像这种纠纷，关键要看这个约定，参加旅行团旅游，它有个报价，这个报价里面你要看清楚，它到底包括什么样的一些范围，什么样的服务项目，一般会写很清楚，包括活动安排，这个时候游客有知情权，可以行使它，游客在出发之前游客不妨问清楚旅行社项目具体包括哪些。<br><br>但是有一条是肯定的，如果明显属于新增加的旅游服务项目，旅行社必须事先争得游客的同意。<br><br>第二个问题，也是游客投诉中比较普遍的一个问题，就是旅行社降低服务标准而引起的纠纷。<br><br>旅行社应当按照约定或者是法定的服务标准为游客提供服务的，如果降低了服务标准，这就是违约，这是一种最“典型的旅游合同当中的违约行为。这种情形下，游客就可以投诉，游客提供缴费的凭证，跟旅行社签订的合同的凭证，以及在整个履行当中旅行社的违约行为、合同当中所提供服务标准等这些情况，就可以证明旅行社违反了合同约定，降低了服务标准。这种情况下，游客可以要求退还相应的费用，游客也可以提出其他的损失赔偿。<br><br>第三个问题，在旅游合同当中，旅行社一方的违约，而导致游客的人身财产损失的责任承担问题。在旅行的过程当中，应当注意安全的事宜，尤其是要确认旅行社确实购买了此次组团相应的旅行社的强制责任保险，也就是由于旅行社的过错，导致游客人身伤害或者财产损害的时候，保险公司代旅行社来承担赔偿责任。<br><br>此外，有可能还会发生和旅行社没有预料到的纠纷，遇到纠纷的时候，游客一定要冷静，同时不要忘记维护权利，关键是保存好相应的证据，游客应当保存好相应的旅行合同、门票、车票、住宿票等相关的证据，及时向旅游质量监督管理机构或者消费者协会投诉。当然，投诉的时候，消费者是靠证据说话的，所以消费者一定要保存好相关的证据。<br></font></td>
