<P>一、背景材料：<BR> 1．一个与药贩子打过交道的卫生执法人员告诉记者，药贩子收药价格是药品批发价的 30％至50％，一些新产品，疗效好，畅销药，药贩子会给到药品批发价的50％。一盒立止血批发价是250元1盒，药贩子会砍价到100--110元1盒，一转手就能卖到250--280元1盒，1盒药就能赚100多元。暴利驱使越来越多的人走进街头收药的行列。一个药贩子曾在电话里对他的一名“顾客”说，“跟我干，保你两年买院子买车”。<BR> 2．从1998年开始，收药的小广告和收药摊开始出现在北京街头，这种小广告以几何数字迅速蔓延，小广告也由传统的手写升级为不干胶印刷，范围遍布大街小巷，墙上、地面，有的竟然明目张胆贴到医院。<BR> 昨天在奉台医院附近抓到的两个药贩子，身上还带着几十张尚未张贴的收药小广告。还有药贩子到劳务市场雇人贴这种小广告，每贴一张给两毛钱，小广告上除了大大的收药两个字外就是寻呼机号或手机号。<BR> 执法人员也是从街头小广告入手，在最近的一次检查中，执法人员在丰台医院附近收集小广告上不同的呼机号就有十几个，海淀区收集了几十个。<BR> 3．昨天在丰台区小井村一药贩子的住处搜查出大量药品，有针剂、有西药，甚至还有一箱减肥茶，卫生执法人员从他的冰箱中拎出两塑料袋不同厂家生产的人血白蛋白o<BR> 4．市药品监督管理局稽查处王处长给记者算了一笔账：“有一种说法是，药贩子收的药主要来自公费医疗开的药，可是从查处的药来看，一般同一种药药量很大，且批号相同，但现在医院大处方查得很严，且公费医疗自己还要负担20％，药贩子收药只给药价的30％一50％，真正通过公费医疗开药去卖的，实在无利可图。”<BR> 5．有分析认为，药贩子的收药来源主要是药厂，医院药库和药品批发部门管理不严，造成药品流失，不排除有偷盗的可能。<BR> 6．昨天记者跟随一路执法人员检查，抓到两名药贩子后，城管监察人员罚没了非法交易的药品和钱款，到他们的窝点收缴了非法收购来的药品后就把他们放了。执法人员向记者解释说，目前能做的也就这些了，法律上还没有明确规定对这类人做怎样的处理，按照有关法规只能没收非法交易的药品和钱款，许多药贩子放回去后重操旧业，这也是药贩子屡禁不止的主要原因。</P><BR>
