<P>一、背景材料：<BR> 1．据余先生称，6月19日他所在公司一位重要客户从昆明来蓉，通过做工作，客户答应用一天时间到该公司看一下。公司安排余先生陪同客户前往重庆参观大足石刻。当日上午10时许，余先生一行花了75元通行费进入成渝高速公路，但车刚驶出几公里，就被迫停下，一打听才知道是在修路。车越堵越多，将余先生的车困在其中动弹不得。堵了一阵，客户想上厕所，可一览无遗的公路上无处可以“方便”，最后在众人“掩护”下才草草了事，弄得体体面面的客户一脸难堪。<BR> 2．余先生说，弄不懂的是在1个多小时的漫长等待中，成渝高速公路公司方竟没有任何人前来现场疏导交通，也没任何人作出解释。<BR> 3．客户到了大足后根本无心游览，因为客户怕耽搁次日乘飞机到北京，就从重庆直飞北京了。余先生空手而归，没完成预定任务。随后客户对公司的货款一拖再拖。为此公司怪罪余先生安排不力，给余先生造成了很大压力，他愤而向成渝高速公路股份公司讨说法。<BR> 4，余先生认为，高速公路既然收路费，消费者交了钱就应享受知情权。公路公司方明知修路可能堵车，就应提前告知，给消费者选择的权力。而且高速路也应按质论价，在通行速度达不到标准时，应降低收费标准。余先生要求成渝公司退还75元通行费，并加倍赔偿。<BR> 5．7月11日上午10时许，四川省消费者权益保护协会组织投诉双方进行了一场座谈。四川省元海律师事务所主任罗元良认为，余某花75元买了成都至桑家坡的高速公路通行票，这就产生了消费行为。而余某选择高速路为的是要享受高速公路提供的高速及道路畅通无阻的权利，但余某却在驶出不到几公里处遭遇了道路修整造成的交通堵塞，严重耽误了余某的时间，根据消费者权益保护法的“消费者为生活需要购买、使用商品或接受服务的合法权益受消法保护”的规定，消费者余某与经营者成渝高速公司之间产生的纠纷适用于《消法》调解。<BR> 6，座谈会上，成渝高速公司的人员发言甚少，成渝高速公路公司副董事长、总经理谭诗礁称，公司不会赔偿。他说，首先高速公路不是商品，其次仅仅具有经营权而没有管理权的成渝高速公司依据的收费标准是国家物价部门统一制定的，公司的收费仅是作为国家公益性基础设施的收费，因而收费行为不是经营行为，公司与交费上高速路的司机不是经营者与消费者的关系，不应适用《消法》来调解。<BR> 7．四川省消协常务副会长谷岩认为，余某要求索赔是有法有据的，省消协十分支持。自成渝高速公路公司依据《公司法》成立股份公司，在省工商局领取执照的那天起，其以盈利为目的的经营者地位就已经明确了，怎么能说该公司与交钱上路的高速路使用者不是经营者与消费者的关系呢?<BR> 8．11日，中消协秘书长杨竖昆接受了记者的电话采访。他认为，成渝高速公司以目前法律上没有明确界定高速公路是商品便否认自身的经营行为，从而认为不适用《消法》是不对的。因为花钱上高速公路买的是服务，既然是消费者为个人生活需要接受的服务，那么不是单纯商品的高速公路同样适用《消法》。</P>
