<P>一、背景材料：<BR> (1)在上海市攻读境外MBA学位的学生蒋某、何某把PCEC英华美上海学院推上了法庭，指控该院通过所谓与境外名校联合办学的名义，有意模糊办学的非学位、非学历培训性质，使他们上了当。<BR> (2)两名学生诉称，1998年8月，他们从《上海人才市场报》上看到，PCEC英华美上海学院为英国莱斯特大学招收MBA学员。该学院散发的《招生信息》称：“1996年10月起，莱斯特大学在上海招收工商管理学员，其课程设置、教材以及各门课程的考核均由莱斯特大学掌握。上课地点在英华美学院。毕业由莱斯特大学授予硕士学位。”两名学生各向该院支付了学费 34000元人民币，之后在该院就读。<BR> (3)1999年6月28日，两名学生突然收到英国莱斯特大学的公函，称：“你们在当地进行的莱斯特大学的学习发生了一些变化。我们与英华美集团的代理协议已经结束。”两名学生认为自己上当受骗，随即委派律师调查，发现该学院主要开展非学历教育。两名学生遂提出退学，并要求该院退还学费，但只收到英国莱斯特大学汇来的相当于9000多元人民币的英镑支票。<BR> (4)PCEC英华美上海学院的代理人辩称，该院一开始就向学生说明，该院只是对莱斯特大学的课程提供辅导，而作业和考试均通过因特网传给莱斯特大学，由该校批改后再传回该学院。毕业后，学生自己向莱斯特大学申请MBA学位，并自费赴英国接受该校颁发的学位证书。目前，该院仍通过与莱斯特大学签有课程辅导协议的香港哈特福特大学，继续对上海的学生进行莱斯特大学的课程辅导。因此，原告仍可通过参加该院的课程辅导来获得莱斯特大学的学位。如要退学，必须扣除已辅导课程的费用。<BR> (5)两名学生认为，他们从PCEC英华美上海学院散发的信息中认定，该院实施的是学历教育，他们是在该院攻读莱斯特大学的课程，在该院获取莱斯特大学的学位，而无需赴英国。<BR> (6)两名学生还对该学院的主体资格提出了质疑。</P>
<P>二、申论要求：<BR>1、请用不超过150字的篇幅，概括出给定资料所反映的主要问题。</P>
<P>2、用不超过350字的篇幅，提出解决给定资料所反映问题的方案。要有条理的说明，要体现针对性和可操作性。</P>

<P>1.<BR> 这是一起关于取得MBA学位还是取得MBA课程辅导的求学纠纷案，PCEC英华美上海学院为招揽生源，在所发布的信息中采用了意思含混的文字表述；两位学生在没有认真了解该学院是否拥有授予或委托授予MBA学位权力的情况下草率入学。而当事情发展与自己的初衷相距越来越远时，只得求助于法律。</P>
<P>2.<BR> 求学者要谨慎选择学校。当今中国的教育处于多层次、多种形式并存的局面o，公办与民办，学历教育与素质教育，一般教育与MBA教育，国内外联合办学……等等。百花齐放、良莠不齐。为此，求学者就不应仅仅凭借传媒上的信息，还要多渠道了解，最好进行实地考察后再做抉择。<BR> 教育主管部门要对办学者严格监督、管理。严禁办学者发布虚假广告和信息。<BR> 司法部门要给予求学者以法律支持。对引导求学者误入．歧途的办学者给予法律制裁。使受害者得到应有的经济补偿。</P>
<P>3.<BR> 关于MBA的思考 <BR> 企业家丰厚的收入和在社会中令人眩目的地位以及频繁出现于媒体，引得当今多少青年人的羡慕。MBA那不同于传统的案例教学、讨论式方法以及为每一个毕业生展现的诱人前景，又引得多少人为之神往。<BR> MBA的莘莘学子为此不惜牺牲了票子、房子、车子、孩子……渴求得到MBA桂冠的青年千方百计寻找这一通向自己美好前途的大门。据调查：中国目前需要CE0100万人，但是，每年只能培养出2000人左右。按这个速度，则需要100年时间。从经济学的角度看，这是中国当今最具诱惑力同时又是利润回报最为丰厚的市场。于是就有了抓住MBA教育市场的供不应求机遇的各种各样的办学者，就有了为MBA而落入“陷阱”的求学者。<BR> 既然MBA有如此大的社会需求，那么各级政府就应该将其纳入教育发展战略体系。调动、配置最优秀的教师资源创办有学历、学位的MBA学院，广召社会有为青年。<BR> 广大有为青年，不要认为没有MBA桂冠就“报国无门”。有作为的人不都是从校门出来的。如世界名人比耳，盖茨，据说只读到大学一年级；如中国当今最有成就的企业家之一“海尔”总裁张瑞敏就没有MBA桂冠，然而，它取得的成就却被收入MBA教材的案例中。可见，取得成就最根本的途径就在于干。 当今世界的全球化和信息化，远程教育的实施，为我们学习各方面知识提供了方便。只要我们学到了真本领，就没有必要追求那顶望而生畏、同时又是没有多大实际价值的虚幻“桂冠”。<BR></P></FONT>
