IF YOU DO NOT AGREE WITH THEM,YOU SHOULDPROMPTLY REMOVE THE SOFTWARE PRODUCTS ARCHIVE FILE.</B></TT></P></PRE><FONT FACE="Arial" SIZE=2>End-User <I>License Agreement</I> is a legal agreement between you the user whether an individual or a legally recognised entity (here in named "<B>LICENSEE</B>") and Australian Real Time Embedded Systems (ARTESYS) (herein named "<B>ARTESYS</B>") for the <B>CORTEX</B> software which includes real time kernel, micro-controller ports and extensions, and any associated media, or on-line electronic documentation, and any printed materials, or any configuration and development facilities (herein named "<B>SOFTWARE PRODUCT</B>").<P align=justify>Use of the <B>SOFTWARE PRODUCT</B> is governed by the terms of the End-User <I>License Agreement</I>accompanies or is included with the <B>SOFTWARE PRODUCT</B>. End users shall not install or use any software that is accompanied by or includes a <I>License Agreement</I>, unless the end user first agrees to the <I>License Agreement</I> terms and conditions.<P align=justify>By exercising rights to make any use of the <B>SOFTWARE PRODUCT</B>,the <B>LICENSEE</B> agrees to be bound by the terms of this <I>License Agreement</I>.<P align=justify><H3>SOFTWARE PRODUCT LICENSE</H3><P align=justify>The <B>SOFTWARE PRODUCT</B> if available for free evaluation in <B>SOURCE CODE</B>forms. <P align=justify>The <B>LICENSEE</B> is granted a non-exclusive license to use the <B>SOFTWARE PRODUCT</B>free of charge for purposes of evaluating the <B>SOFTWARE PRODUCT</B> (to purchase a license contact the Licensor via the Internet at <a href="http://www.artesys.com.au">http://www.artesys.com.au</a>).<P align=justify>The <B>LICENSEE</B> may not modify (except to the extent applicable laws specifically prohibit such restriction), or create derivative works based on the <B>SOFTWARE PRODUCT</B>; copy the <B>SOFTWARE PRODUCT</B> ; rent or lease; or remove any proprietary notices or labels on the <B>SOFTWARE PRODUCT</B>; or to use the <B>SOFTWARE PRODUCT</B> for any commercial purposes.<H3>REPRODUCTION AND DISTRIBUTION</H3><P align=justify>Any reproduction or redistribution of the Software not in accordance with the <I>License Agreement</I> is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible. <H3>DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS</H3><H4>TERMINATION</H4><P align=justify>Without prejudice to any other rights, <I><B>Australian Real Time Embedded Systems (ARTESYS)</B></I>may terminate this <I>License Agreement</I> if the <B>LICENSEE</B> fails to comply with the terms and conditions of this <I>License Agreement</I>. In such an event, the <B>LICENSEE</B> must destroy ALL copies of the <B>SOFTWARE PRODUCT</B> and ALL its component parts.<P align=justify>Where required by <B>ARTESYS</B>, the <B>LICENSEE</B> shall do all such things and acts, including but not limited to, signing a statutory declaration or affidavit verifying that the <B>LICENSEE</B> has destroyed ALL copies of the <B>SOFTWARE PRODUCT</B> and ALL of it'scomponents in accordance with <B>ARTESYS'S</B> requirements following the termination of this<I>License Agreement</I>.<H4>OTHER RESTRICTIONS</H4><P align=justify>The <B>LICENSEE</B> may not rent or lease the <B>SOFTWARE PRODUCT</B>. The <B>LICENSEE</B> is allowed permanently transfer all rights under this <I>License Agreement</I>, provided that the<B>LICENSEE</B> retain no copies of the <B>SOFTWARE PRODUCT</B>, transfers all of the <B>SOFTWARE PRODUCT</B>(including all component parts, the media, any printed materials, and upgrades and this<I>License Agreement</I>), and the recipient agrees to the terms of this <I>License Agreement</I>.If the <B>SOFTWARE PRODUCT</B> is an upgrade, any transfer must include all prior versions of the<B>SOFTWARE PRODUCT</B>.<P align=justify>Remove or destroy any of our proprietary markings on the <B>SOFTWARE PRODUCT</B> or use is for illegal purposes is prohibited.<H3>COPYRIGHT</H3><P align=justify>All title and copyrights in and to the <B>SOFTWARE PRODUCT</B> (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets"incorporated into the <B>SOFTWARE PRODUCT</B>), the accompanying printed materials, and any copies of the <B>SOFTWARE PRODUCT</B>, are owned by <I>Australian Real Time EmbeddedSystems (ARTESYS)</I>. The <B>SOFTWARE PRODUCT</B> is protected by copyright laws and international treaty provisions. Therefore, the <B>LICENSEE</B> must treat the <B>SOFTWARE PRODUCT</B> like any other copyrighted material.<P align=justify>It is required that this PRODUCT contains the author's (<I>Australian Real Time Embedded Systems (ARTESYS)</I>) copyright notification.
