Elfving denied a <BR> request by the DVD Copy Control Association to submit code-bearing <BR> T-shirts into evidence on Friday. <BR> <BR> The DVD CCA represents the motion picture and DVD industries in its <BR> suit against 72 hackers and Internet authors accused of trade-secret <BR> theft. <BR> <BR> A group of the defendants' sympathizers had handed the T-shirts, which <BR> feature a DVD CCA logo and a red line through it on the front, and the <BR> source code to the CSS decryption software on the back, to the <BR> plaintiffs' attorneys on the way out of the court house at a <BR> preliminary injunction hearing earlier this week. <BR> <BR> "Here, take these," some of the hackers said. "They're from a bunch of <BR> criminals." <BR> <BR> Friday's rush request hearing is the third in the case filed in <BR> December by the Morgan Hill, California-based DVD CCA against 72 <BR> hackers and Internet authors accused of stealing trade secrets. So <BR> far, Elfving has denied plaintiff's request for a temporary <BR> restraining order and has yet to decide on the DVD industry's request <BR> for a preliminary injunction. <BR> <BR> The defense, which says the hackers are simply open source advocates <BR> trying to learn how to play DVDs without the Windows OS, hopes <BR> Friday's development spells good things for them. <BR> <BR> "I'm optimistic," said Robin Gross, attorney from the Electronic <BR> Frontier Foundation, which is representing the defendants in this case <BR> and in two related federal cases in New York and Connecticut.
