Oxygen TOxygenSMS Component Software License Agreement

BEFORE PROCEEDING WITH THE INSTALLATION 
AND/OR USE OF THIS SOFTWARE, CAREFULLY
READ THE FOLLOWING TERMS AND CONDITIONS
OF THIS LICENSE AGREEMENT AND LIMITED
WARRANTY (The "Agreement").

BY INSTALLING OR USING THIS SOFTWARE YOU
INDICATE YOUR ACCEPTANCE OF THIS
AGREEMENT. IF YOU DO NOT ACCEPT OR AGREE
WITH THESE TERMS, YOU MAY NOT INSTALL OR
USE THIS SOFTWARE!


1. Introduction.  This agreement explains when and how you may use both
   Registered and Freeware Copies of TOxygenSMS. 

   In this agreement:

   *  "Oxygen TOxygenSMS Component" means the Oxygen TOxygenSMS Component you
      have purchased or obtained for evaluation, including both the component
      software and the associated documentation and other materials.

   *  "Freeware Copy" means a copy of Oxygen TOxygenSMS Component
      distributed by us or by our authorized agents for trial use.  The 
      Trial-Run Copy contains nag-screen.

   *  "Registered Copy" means a copy of the Oxygen TOxygenSMS Component 
      without nag-screen purchased from us or an approved vendor.

   *  "we" or "us" means Oxygen Software.

   *  "you" means the end user of Oxygen TOxygenSMS Component.

   *  "Commercial Application" any application that will be distributed
      to others for any kind of compensation or fee.  This includes
      shareware and other try before you buy as well as commercial
      distribution methods.


2. Legal Agreement.  This is a legal agreement which allows you, the end
   user, to use Oxygen TOxygenSMS Component under certain terms and 
   conditions.  If you cannot agree to abide by the terms of this 
   agreement you should not use Oxygen TOxygenSMS Component.

3. Copyright. Oxygen TOxygenSMS Component is fully protected by copyright
   under US law and international treaty provisions.

4. Use of Oxygen TOxygenSMS Component. You may use the Freeware Copy of 
   Oxygen TOxygenSMS Component on as many computers as you like for an unlimited time 
   period to develop trial applications.  If you have the registered 
   Oxygen TOxygenSMS Component your use is subject to the following 
   restrictions:

   A. You agree not to distribute compiled copies of the DCUs that
      were created by Delphi and the Registered Copy.

   B. You agree to not recompile the source code for Oxygen TOxygenSMS
      Component and redistribute it in compiled or source 
      code form under the pretense that it is your product or that you 
      are the author. You may however use modified versions of 
      Oxygen TOxygenSMS Component within your own applications or
      components.  You may not redistribute derived components without
      advanced written permission from Oxygen Software.

   C. You agree to not distribute other components (VCL or OCX) total or
      partially based in Oxygen TOxygenSMS Component. 

   D. You agree to not distribute the source code for Oxygen TOxygenSMS
      Component or portions of the source code, in the original form or
      modified.

   If you have the registered Oxygen TOxygenSMS Component you may use 
   Oxygen TOxygenSMS Component or a modified version of 
   Oxygen TOxygenSMS Component within your own Commercial Applications 
   or non-Commercial Applications provided the above restrictions are not 
   violated.

   You assume full responsibility for the selection and use of 
   Oxygen TOxygenSMS Component to achieve your intended results.

5. Making and Distributing Compiled applications based in 
   Oxygen TOxygenSMS Component.  You may make copies of your applications 
   compiled with Oxygen TOxygenSMS Component to give to others, as long as 
   you don't distribute the source code of Oxygen TOxygenSMS Component or 
   any DCU of Oxygen TOxygenSMS Component with that application.  You agree 
   not to distribute applications compiled with the Freeware copy of 
   Oxygen TOxygenSMS Component.  The license to distribute applications
   based in the registered copy of Oxygen TOxygenSMS Component is 
   royalty-free.

6. Copying Registered Copies of Oxygen TOxygenSMS Component.  When you 
   receive a Registered Copy of Oxygen TOxygenSMS Component you may make 
   copies of Oxygen TOxygenSMS Component software which are necessary for 
   normal backup purposes.  You agree not to make any other copies of the 
   software, or any part of them, or sell or give any copies to others, 
   without our advance written permission.

   A. You agree not to recompile the source code for Oxygen TOxygenSMS
      Component and redistribute it in compiled or source
      code form under the pretense that it is your product or that you
      are the author. You may however use modified versions of
      Oxygen TOxygenSMS Component within your own applications or 
      components.  You may not redistribute derived components without
      written permission from Oxygen Software.

   B. You agree to treat the license for Oxygen TOxygenSMS Component like a
      book, negating the possibility that two people may use your 
      registered Copy simultaneously.

7. LIMITED WARRANTY:  The following limited warranty applies to
   Registered Copies of Oxygen TOxygenSMS Component.  It is included 
   here so you understand what your warranty will be when you 
   purchase a Registered Copy.  This warranty does NOT apply to 
   Freeware Copies of Oxygen TOxygenSMS Component.

   Bugs and Program Errors.  We do not promise that 
   Oxygen TOxygenSMS Component will be free of bugs or program errors.  
   If you report a program error or bug to us, we will use our best 
   efforts to correct it.  If we issue a maintenance release for 
   Oxygen TOxygenSMS Component which includes a correction for an
   error you reported, we will send you a copy of that maintenance
   release at no charge if you request it.  We will only do this for
   maintenance releases, not for new major releases or other new 
   versions of Oxygen TOxygenSMS Component.


8. Disclaimers and Limitations.  

   Disclaimer for Freeware Copies:  You are not paying for the use
   license for your Freeware Copy of Oxygen TOxygenSMS Component.  
   Accordingly the Freeware Copy is provided "AS-IS" and without 
   warranty of any kind.

   Disclaimer for Registered Copies:  Except for the limited warranty
   stated above, we disclaim any and all other warranties, express or
   implied, oral or written, including any implied warranties of
   merchantability or fitness for a particular purpose.  The limited
   warranty above gives you specific legal rights, but you may have other
   rights, which vary from state to state.

   Limitation of Liability:  In no event shall we be liable for any
   incidental, consequential, or punitive damages whatsoever arising out
   of the use of Oxygen TOxygenSMS Component or your relationship with us. 
   Some states do not allow exclusion or limitation of liability for 
   incidental or consequential damages, therefore the above limitation 
   may not apply to you.

CERTAIN JURISDICTIONS PROVIDE FOR GREATER RIGHTS THAN WHAT IS PROVIDED 
INTHIS AGREEMENT.  YOUR RIGHTS WITH RESPECT TO THIS AGREEMENT MAY VARY 
DEPENDING ON YOUR JURISDICTION
